The new Federal Nature Conservation Act came into force on 1 March 2010. It is based on a new constitutional concept: until now, the framework legislation resulted at the federal level, while the essential design was undertaken through state laws.
The 2010 Federal Nature Conservation Act however, changes this basic approach. It sets out design guidelines that were previously covered, often in very different ways, only at the state level. These may now deviate only in a few areas from the guidelines, with activities that can be carried out through new state-level nature conservation legislation.
The state of Brandenburg plans to have the appropriate laws come into force by the end of 2011. The project will also study and analyse specific questions on nature conservation laws that arise from general developments in this legislative field as well as from the new state-level skills.
